Fulton County Judge McBurney rejected Rudy Giuliani’s claim that he cannot fly to appear in court due to health concerns Tuesday, saying that Mr Giuliani could find another way to travel to Georgia. Giuliani was ordered to testify Tuesday before a Fulton County special grand jury investigating Trump's efforts to overturn the election. On Monday he filed an emergency application to postpone the appearance, with his lawyers citing a doctor who said Giuliani is unable to fly following a heart stent operation.
JUDGE McBURNEY: The medical professional said that Mr. Giuliani is not cleared for air travel, A-I-R. John Madden drove all over the country in his big bus from stadium to stadium. So one thing we need to explore is whether Mr. Giuliani could get here without jeopardizing his recovery and his health on a train on a bus or Uber, whatever it would be. The focus seems to have been, he's got to be on a plane. New York is not close to Atlanta but it's not traveling from Fairbanks.
